Terms and Conditions of Sale for all Products
All Sales made by Incredible Cakes of Cambridge (the Company) are subject to the following terms and conditions. Nothing contained within these terms and conditions affects your (the Customer’s) statutory rights as a consumer. Please read the following terms and conditions, if there is anything you (the Customer) don’t understand please ask for an explanation.
The price for the order shall be as stated on the Customer’s Order Form. The Customer agrees to pay the full price to the Company in accordance with these Terms and Conditions
All orders require a deposit of 50% of the total price. Please note deposits are non-refundable and non-transferable. The deposit becomes due upon placing the order, once the Customer has checked and agreed the details on the Order Form. Orders are deemed to have been accepted only when the deposit has been paid.
Payments may be made by: Automated payments – Direct Bank or Building Society Transfer
Bank or Building Society Cheque
Final payment for wedding and civil partnership orders must be made 3 months prior to the date required. For wedding and civil partnership orders placed within 3 months of the date required, full payment is due at the time of ordering. This time period is reduced to 1 month for orders other than those for weddings and civil partnerships. Any agreed variation on this should be stated on the Customer’s Order Form. Payment details for corporate orders will be agreed at the time of booking.
In the event that any payment is subsequently declined (e.g. a cheque bounces or a direct payment is not actioned), the order will not be completed or released until alternative funding arrangements are agreed and payment has been made in full. Once the payment is cleared the Company will make its best endeavours to meet the delivery date but this cannot be guaranteed. The Company accepts no responsibility for any loss howsoever caused or for non-delivery under these circumstances.
The customer will be responsible for any additional charges incurred by the Company as a result of payment failure.
Alterations to orders
The Customer is responsible for ensuring that the contents of the Order Form are accurate. Please let the Company know within three days of placing an order if changes are required.
It is the Customer’s responsibility to advise the Company of any alterations to the original order. The Company reserves the right to increase a quoted price in the event that the Customer requests a variation to the work agreed. Whilst every effort will be made to assist Customers, please note that late changes and particularly those within 4 weeks of the date required cannot always be guaranteed.
Orders may be collected at any reasonable time by prior arrangement. A signature is required upon collection, confirming that the order has been received in good condition and as specified. If the order is not collected at the pre-arranged time and the Company has not been notified, the Company will not be held responsible for returning any monies if the Company is subsequently unavailable for order collection.
Local orders can be delivered any reasonable time by prior arrangement. Delivery by courier should be organised at the time of placing an order. The price for delivery will be agreed in advance and will depend upon location.
It is the Customer’s responsibility to ensure that they have provided full and correct delivery information and that someone is available to receive the cake. A signature is required upon delivery confirming that the order has been received in good condition and as specified. If delivery is to a venue the name of the person responsible for receiving the order will be required before the delivery can take place.
If the recipient is not in or not available, the order will be returned to the Company who will attempt to contact the Customer. If possible, the Company will arrange an alternative delivery slot for which an additional charge must be paid for by the Customer, before the delivery is made. The Company accepts no responsibility for any loss or consequential loss incurred by the Customer as a result of this, e.g. a wedding without a wedding cake.
Personal delivery is offered locally (Cambridge and surrounding villages). Delivery to the remainder of the UK mainland is usually by courier. In the event that your order is delivered by a courier organised by the Company, please check your order before signing for it, as once signed for, any compensation for damages will have to be claimed from the courier by the Customer. For orders that are delivered by a courier organised by the Customer, the Company will accept no responsibility for the order once handed to and signed for by the courier company.
The Company cannot be held responsible for any damaged caused by delivery/collection once the product has been signed for.
For wedding and civil partnership cakes a set-up service can be provided at the venue; any additional cost will be conveyed to the Customer at the time of ordering. Once the cake has been set up a signature will be required and a photograph will be taken after which, no further responsibility for the cake will be taken by the Company.
Products are made specifically for each Customer and are reserved solely for that Customer. Certain components may be ordered months in advance. The following conditions are implemented when an order is cancelled.
For wedding and civil ceremony orders:
3 months or more from date required – cancellation charges will be 50% of the total cost
Less than 3 months from date required – cancellation charges will be 100% of the total cost.
For all other orders:
1 month or more from date required – cancellation charges will be 50% of the total cost
Less than 1 month from date required – cancellation charges will be 100% of the total cost.
All cancellations must be in writing, quoting the name, required date and type of product, as stated on the Order Form and followed up with a phone call to the Company.
If a for any reason after the product has been delivered/collected it is considered not fit for consumption the Company should be contacted immediately and the product returned to the Company uneaten, straight away or at least within 24 hours of delivery/collection. If this procedure is not followed or/and storage instructions are not adhered to, a refund will not be considered due to the perishable nature of the product.
Please note that no person shall have an entitlement to copy or reproduce in any form, or otherwise make use of any image, photograph, design or other document or item produced by or on behalf of the Company without the prior written consent of the Company.
Publication and Promotional Rights
By signing the Order Form or agreeing to the details contained therein in writing (including but not limited to agreeing electronically, e.g. by email) the Customer agrees that the Company is the sole designer and owner of the final cake design. All rights in any original designs created and designed by the Company shall remain the exclusive property of the Company. From time to time our designs are published in the media e.g. wedding/cake craft magazines and on the internet. We reserve the right to use any image of a Customer’s cake or other such product made by the Company for publication after delivery date unless previously agreed in writing between the Customer and the Company.
The Customer has no ownership rights over any cake design. Exclusivity of cake designs between our Customers is not guaranteed unless the Customer commissions an exclusive design.
Allergies Please note that any dietary requirements must be mentioned at the time of booking. If not specified at this time then the finished cake will not be suitable for anyone with any particular type of food intolerance. Please be aware that whilst the chosen cake may not be made with nuts or a nut product, it will be prepared in a kitchen where nut products may be used in other cakes and fillings. The same applies to gluten, lactose, soya, egg and other allergen- free cakes that are requested. Please also be aware that some raw materials used may be produced in an environment where nuts are present. Allergen information is provided with the cake. It is the Customer’s responsibility to relay dietary requirements to the Company at the time of placing an order.
All cakes are handmade and whilst the Company will endeavour to match any design or colour, slight differences may occur.
In certain circumstances it may be necessary to adjust the order for reasons beyond the Company’s control (e.g. a raw material no longer being available). In this instance the Customer will be notified.
We, the Company reserve the right to use our artistic judgement when designing and creating an order. Should it be necessary to alter an order in any major way the Company will consult with the Customer in advance.
Most cake decorations and figures are handcrafted in sugar. However a number may contain wires (flowers in particular) and non-edible supports. We therefore strongly recommend that decorations are not eaten and are removed from the cake before it is cut. Customers are responsible for ensuring caterers and venues are aware of this.
Any agreed deviance from these terms and conditions will be stated on the Customer’s order form.
